SMS Terms and Conditions

1. Program Description

By providing your mobile number and agreeing to these Terms and Conditions, you consent to receive text messages (SMS/MMS) from Echelon Contrast Suites (“Echelon,” “we,” “us,” “our”) related to your inquiries, appointments, membership, and our wellness services, including follow‑ups, reminders, and limited promotional messages. Messages may be sent using an automated system.

You are not required to consent to receive text messages as a condition of purchasing any goods or services.

2. Consent to Receive Text Messages

By checking the consent box or otherwise affirmatively opting in (for example, submitting your phone number through our website form or texting a keyword to our number), you provide prior express written consent for Echelon to send you marketing, informational, and transactional text messages at the mobile number you provide.

You represent that you are the owner or authorized user of the mobile number you provide and that you are at least 18 years old (or have the consent of a parent/guardian, if applicable).

3. Message Frequency

Message frequency will vary based on your interactions with us, but you can expect up to approximately 4–8 messages per month, including follow‑ups, reminders, and occasional promotional offers.

4. Cost and Carriers

Message and data rates may apply to each SMS or MMS message sent or received, as provided in your mobile telephone service plan, in addition to any applicable roaming charges. You are responsible for any such charges.

Supported carriers may change at any time and are not responsible for delayed or undelivered messages.

5. How to Opt Out

You may opt out of receiving marketing and promotional text messages from us at any time. To stop receiving messages, reply STOP to any message you receive from us. After you send STOP, we may send you a single confirmation text message stating that you will no longer receive text messages from that program.

Your opt‑out will be honored as required by federal law and applicable South Carolina telephone solicitation rules.

If you opt out of marketing messages, we may still send you non‑marketing texts permitted by law, such as important account or appointment‑related messages, if applicable and if we have another lawful basis to contact you.

7. Consent Recordkeeping

By opting in, you agree that we may maintain records of your consent, including the date, time, method of consent, and the specific language presented at the time you enrolled, to demonstrate compliance with the Telephone Consumer Protection Act (TCPA), related FCC rules, and applicable South Carolina requirements.

8. Eligibility and Geographic Scope

Our texting program is intended for individuals located in the United States. By consenting, you acknowledge that US federal law (including the TCPA) and South Carolina law govern our texting practices, in addition to carrier and industry guidelines (such as CTIA Messaging Principles and Best Practices).

9. Your Responsibilities

You agree to:

  • Provide accurate, current mobile contact information.

  • Notify us promptly if you change or deactivate your mobile number.

  • Not enroll a mobile number that is not your own.

10. Program Changes and Termination

We may change, suspend, or discontinue our text messaging program, or these Terms and Conditions, at any time, with or without notice, as permitted by law. Any changes will be effective when we post the updated terms on our website or otherwise provide notice.

11. Disclaimers

Delivery of messages is subject to effective transmission by your wireless carrier, and we are not liable for delayed, failed, or misdirected messages. Text messages may not be secure; avoid replying with sensitive personal medical information.

This messaging program is for informational and marketing purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified health care provider regarding any questions about a medical condition.

12. Privacy

We handle personal information, including your mobile number, in accordance with our Privacy Policy, which explains how we collect, use, and protect your information. By enrolling in our text messaging program, you acknowledge that you have reviewed our Privacy Policy and consent to our data practices described there.

13. Governing Law

These Terms and Conditions and any disputes arising from or relating to the text messaging program are governed by the laws of the United States and the State of South Carolina, without regard to conflict of law principles.
